1. Acceptance of Terms and Conditions

1. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy.

4. We use YouTube's API Services to provide video content. When you watch videos, you are also subject to YouTube's Terms of Service and Google's Privacy Policy. If you don't agree with them, you must not watch videos on the Site.

2. Service Description

1. Video Pundits provides a platform where users can watch YouTube videos and create personal notes associated with those videos.
2. Our service is designed for educational and learning purposes only. It is not intended to promote or incentivize violence, political, religious, racist, or any other forms of cults or ideologies.
3. While some features are free, some require a paid subscription.
4. We reserve the right to modify or terminate the Site and its services at any time, without prior notice, but we will strive to notify you via email if we do so. We will not be liable for any loss of data or paid subscription up to the date of the decision or for any remaining paid subscription.

3. User Accounts and Eligibility

1. Users must register for an account to access the service. You are responsible for maintaining the confidentiality of your account credentials.
2. To register, you must provide a valid email, username, and password, which will be securely hashed and stored has per industry best practices. Your email will be only used to send you notifications and updates.
3. Users under the age of majority should use the service under parental guidance.
4. We reserve the right to limit, suspend or terminate and delete accounts that violate these terms or for any other reason at our discretion. You will be given a chance to appeal the decision by replying to the email we sent you. More details on this can be found in section 5.

4. User Responsibilities & Conduct

1. Users agree to interact with others and the service's content in a respectful, lawful, and courteous manner.
2. Users agree not to:
   1. Use the service for any illegal purpose.
   2. Share inappropriate or offensive content.
   3. Attempt to circumvent any security measures of the Site.
   4. Share account access with others.
   5. Engage in harassment, hate speech, or any form of discrimination.
   6. Transmit harmful code or attempt unauthorized access.
   7. Circunsvent any rules of accessing and using the services of the Site, paid or free.

5. Limitation, Suspension & Termination of Accounts

1. Notice of Limitation, Suspension or Termination: We will notify you via email if your account is limited, suspended, or terminated. To appeal the decision, you must reply to the email we sent you. After the appeal, we will review the decision and may or may not ask further questions. Once a decision is made, we will notify you via email if the decision is upheld. If upheld, the decision is final, and no further appeal is possible.
2. Grounds for Limitation, Suspension or Termination: We may limit, suspend or terminate and delete accounts at our discretion, including for posting inappropriate content, attempting to harm the Site, innapropriate conduct, or any other reason we deem fit.
3. Effect of Limitation: Upon limitation, your right to access the Site is limited and certain features and services are disabled. We will notify you via email if your account is limited and wait for you to appeal for up to three days.
4. Effect of Suspension or Termination: Upon suspension or termination, your right to access the Site ceases immediately. We will notify you via email if your account is suspended or terminated and wait for you to appeal for up to three days.
5. Deletion of Data: Upon termination, we may delete your account and any associated data, including notes, comments, and other content. Deletion only occurs after the appeal is upheld, thus you may ask for a copy of your data before the deletion, but only when you have not violated any of the terms of this T&Cs.
6. No Compensation: You will not be compensated for any loss of access to the Site and its services, nor reimbursed for any loss of data or paid subscription up to the date of the decision or for any remaining paid subscription.

6. Content and Copyright

1. YouTube Copyright and Terms of Service: All videos are sourced from YouTube and remain subject to YouTube's Copyright and Terms of Service.
2. Prohibited Content: Content that is unlawful, defamatory, threatening, harassing, hateful, obscene, or infringes on intellectual property or privacy rights is prohibited. This includes any form of violence, political, religious, racist, or any other form of cults or ideologies. Just because it's on Youtube doesn't mean it's allowed in this Site.
3. Accuracy & Ownership: Users are responsible for the accuracy of their notes and the ownership of their content.
4. Copyrighted Content: Users must not share copyrighted content without permission of their owners.
5. Notes Ownership: Notes created by users remain their intellectual property, and are kept private by default, unless they are shared with others or made public in this Site.

7. Privacy & Data Protection

Refer to our Privacy Policy for more details, but in a nutshell:

1. Personal Information: If you register, we collect your email, name, username, and password. Passwords are securely hashed and not stored in plain text.
2. Data Use & Sharing: We do not sell or share your personal data with third parties. You are not the product of the Site.
3. Security Measures: We use industry-standard security measures and best practices, but no method of storage or transmission of data is completely secure against all threats posed by attackers.
4. Acceptance: By using our service, you consent to our Privacy Policy and data practices.

8. Disclaimers & Limitations

1. No Warranties: The services provided by the Site and its content are provided "as is" without warranties.
2. Limitation of Liability: To the fullest extent permitted by the governing law, see section 9, Video Pundits shall not be liable for any direct, indirect, incidental, special, or consequential damages related to your use of the service. If you don't agree with this, or its not clear to you, you must not use the service.

9. Governing Law

1. These Terms and Conditions are governed by the laws of Scotland, United Kingdom, without regard to conflict of law principles. This means that regardless of your location, nationality and jurisdiction, you agree to be bound by the laws of Scotland.
2. By using the Site, you consent to the jurisdiction of the courts of Scotland.
3. If you don't agree with this, or its not clear to you, you must not use this Site.

10. Changes to Terms

1. We may modify these terms at any time.
2. Continued use of the service after changes constitutes acceptance of the new terms.
